Binding Agreement: By accessing this website and placing an order, the customer (“You”) enters into a legally binding contract with Modern Blooms.

Mandatory 48-Hour Lead Time: * No Rush Service: Modern Blooms does not offer same-day, next-day, or “rush” fulfillment. Every arrangement requires a minimum 48-hour preparation period.

6:00 PM Cut-off Rule: Any order placed after 6:00 PM (PHT) is legally deemed received on the following business day. Your 48-hour window begins from that following business day.

Payment & Order Finality: * Payment-First Policy: We do not queue orders for flower procurement or production until full payment is verified.

Proof of Payment: It is the customer’s sole responsibility to upload/send a clear screenshot of the Cash, Maya, or Bank Transfer. Modern Blooms is not liable for delayed delivery caused by a delay in payment verification.

No COD: We do not offer Cash on Delivery under any circumstances.

Artistic Substitution Policy (The Florist’s Discretion): * Nature of Product: Flowers are living organisms; exact colors, stem counts, and bloom sizes fluctuate daily based on climate and seasonality.

Substitution Rights: We reserve the right to substitute flower varieties, greenery, or packaging materials with alternatives of equal or greater value without prior notice.

Design Integrity: We guarantee to maintain the overall style, “spirit,” and color palette of the arrangement. Substitutions do not constitute a “wrong item” and are not grounds for a refund.

Limitation of Liability: To the maximum extent permitted by law, Modern Blooms total liability for any claim shall not exceed the original purchase price paid. We are not liable for incidental, indirect, or “emotional distress” damages resulting from late or failed deliveries.

Shipping Policy

This protects you from courier accidents and recipient issues.

Service Area: Our standard delivery service is restricted to the National Capital Region (NCR), Philippines.

Delivery Windows & Expectations: ” Standard Window: Deliveries are conducted between 8:00 AM and 6:00 PM.

No Time Guarantees: While we accept ‘preferred dates,” we do not guarantee exact arrival times. We are not responsible for delays cause by Metro Manila traffic, monsoon weather, or courier availability.

Transfer of Risk (Third-Party Couriers): * Independent Logistics: We utilize third-party services (e.g., Lalamove, Grab).

Risk Handover: All risk of loss, wilting, or damage passes to the customer the moment the order is handed to the courier at our studio. Modern Blooms is not liable for accidents, spills, or theft occurring during transit.

Recipient Responsibility & Access: * Accuracy: The customer must provide an accurate address and a reachable contact number for the recipient.

Unavailability: If the recipient is unreachable, the courier will attempt to leave the flowers with a concierge, security guard, or neighbor. If delivery is impossible, the order is deemed “Fulfilled.”

Redelivery Fees: Any redelivery attempt will incur a new dolivery fee, and wo cannot guarantee flower freshness for redelivered items.

Force Majeure: Modern Blooms is not liable for failures to perform due to typhoons, flooding, government lockdowns, or major road closures.

Refund And Cancellation Policy

This protects your revenue and materials cost.

Perishable Goods (Final Sale): Because our products are live, perishable, and custom-made, all sales are final. We do not accept returns, exchanges, or “change of mind” refunds once an order is placed.

Cancellation Terms: * Administrative Fee: Approved cancellations (requested before preparation) are subject to a 30% restocking and administrative fee to cover transaction costs and reserved inventory.

No Cancellation After Preparation: Once flowers have been cut, arranged, or the bouquet is in transit, no cancellations or refunds are permitted for any reason.

The 24-Hour Quality Guarantee: * Reporting Window: Any dissatisfaction regarding freshness or condition must be reported within 24 hours of deliv- ery.

Evidence Requirement: You must provide clear, high-resolution photo and video evidence of the arrangement as received.

Resolution: If a defect is confirmed to be on our part, we will provide a replacement or store credit at our sole discretion. Claims submitted after 24 hours or without video proof will be automatically denied.

Care Responsibility: Once delivered, the recipient is responsible for proper care (water, temperature, placement). Modern Blooms is not liable for reduced flower life due to improper handling after delivery.

Billing Terms & Conditions

1. CURRENCY & PRICING Currency: All prices listed on our website are in Philippine Pesos (PHP). Price Adjustments: Modern Blooms reserves the right to adjust pricing at any time without prior notice. Seasonal Surcharges: Prices for specific floral varieties may increase during peak demand periods (e.g., Valentine’s Day, Mother’s Day, All Saints’ Day). The price at the moment of checkout is the final price for that transaction.

2. MANDATORY PRE-PAYMENT POLICY No COD: Modern Blooms does not accept Cash on Delivery (COD). Full Payment Requirement: To secure a delivery slot and begin the 48-hour preparation period, orders must be paid in full. We do not accept partial payments or “reservations” without full settlement of the invoice.

3. ACCEPTED PAYMENT METHODS We currently accept the following digital and bank-based payment methods: Digital Wallets: Cash, Maya, Gotyme Bank Transfers: (Specify your banks, e.g., BDO, BPI, Unionbank) via InstaPay or PESONet. Transaction Fees: Any fees incurred during the transfer (e.g., the $15 or 825 InstaPay fee) are the sole responsibility of the customer. The net amount received by Modern Blooms must match the total order value.

4. PAYMENT VERIFICATION & PROOF The “Screenshot” Rule: It is the customer’s responsibility to provide a clear, unedited Proof of Payment (transaction receipt/screenshot). Validation Period: An order status will remain “Pending” until our finance team verifies the reflection in our account.

Delayed Verification: If a customer fails to send proof of payment promptly, the 48-hour lead time will be counted from the moment the proof is finally submitted, not the moment the order was placed on the website.

5. BILLING ERRORS & DISPUTES Reporting: If you believe you have been overcharged or there is a discrepancy in your billing, you must notify us at modernbloomsph@gmail.com within 24 hours of the transaction. Double Payments: In the event of an accidental double payment, the amount can either be converted into Store Credit (no fee) or refunded via the original payment method (subject to a 5% merchant processing fee).

CANCELLATION & RESTOCKING FEES Administrative Deduction: As noted in our Refund Policy, any approved cancellation requested before the 48-hour preparation window begins is subject to a 30% administrative and restocking fee. Rationale: This fee covers non-refundable digital transaction fees, bank charges, and the loss of inventory opportunity for the reserved delivery slot.

7. PAYMENT SECURITY & DATA PRIVACY No Data Storage: Modern Blooms does not see or store your bank login credentials, PINs, or CV numbers. All transactions are processed through encrypted third-party platforms (Cash, Maya, or your respective banking apps). Compliance: All billing information is handled in accordance with the Philippine Data Privacy Act of 2012.

8. INVOICING Digital Receipts: Upon successful payment verification, an automated digital order confirmation will be sent to the email address you have registered. This serves as your primary proof of purchase.
